1. Introduction

These Terms of Service ("Terms") govern your access to and use of portfoliogen.io and the services provided by STUDIO ELEVEN.

By using the website, you agree to be bound by these Terms. If you do not agree to these Terms, you must stop using the website.

2. Definitions

• "Service": refers to the PortfolioGen platform for creating and hosting online portfolios.
• "User": refers to any person accessing the website and using the services.
• "Account": refers to the user's personal space created upon registration.
• "Content": refers to text, images, and information provided by the user.
• "Portfolio": refers to the website generated by the Service.

3. Service Description

PortfolioGen provides the following services:

• Generation of professional portfolios from user-provided information
• AI-powered content enhancement
• Portfolio download in ZIP format
• Portfolio hosting on a subdomain (Pro plan)

4. Account Registration

Using certain features requires creating an account. The user agrees to:

• Provide accurate and current information
• Maintain the confidentiality of login credentials
• Immediately notify any unauthorized use of their account
• Be responsible for all activities performed from their account

5. Acceptable Use

The user agrees to use the Service lawfully. It is prohibited to:

• Publish illegal, defamatory, obscene content or content that infringes on others' rights
• Impersonate another person
• Use the Service for fraudulent purposes
• Attempt to bypass security measures
• Resell or redistribute the Service without authorization
• Use bots or automated scripts

6. User Content

The user retains ownership of the content they provide. By using the Service, they grant STUDIO ELEVEN a limited license to:

• Store and process content to provide the Service
• Display the hosted portfolio to visitors

The user warrants they have the necessary rights to the content provided and that it does not infringe any third-party rights.

7. Intellectual Property

The templates, source code, trademarks, and all Service content are the property of STUDIO ELEVEN and are protected by intellectual property law.

The user is granted a personal use license (Free, Templates plans) or commercial license (Pro plan) depending on their subscription.

8. Limitation of Liability

The Service is provided "as is." STUDIO ELEVEN does not guarantee:

• Continuous and uninterrupted availability of the Service
• Absence of errors or bugs
• Compatibility with all browsers or devices

In no event shall STUDIO ELEVEN be liable for indirect damages, data loss, loss of profits, or business interruption.

9. Termination

The user may delete their account at any time from their dashboard.

STUDIO ELEVEN reserves the right to suspend or delete an account in case of violation of these Terms, without notice or compensation.

10. Modifications

STUDIO ELEVEN may modify these Terms at any time. Users will be notified of substantial changes by email or notification on the website. Continued use of the Service after modification constitutes acceptance of the new Terms.

11. Applicable Law and Disputes

These Terms are governed by French law.

In case of dispute, the parties will endeavor to find an amicable solution. Failing that, the courts of Lyon shall have exclusive jurisdiction.
